    NEW BALANCE RUN CLUB (New Balance Middle East L.L.C) COMMUNITY SESSIONS – TERMS AND CONDITIONS


    These are the Terms and Conditions that apply to New Balance Run Club (NEW BALANCE MIDDLE EAST LLC’s) NBRC COMMUNITY SESSIONS.

    The person registering on website (“Participant”) voluntarily chooses to attend and take part in the NBRC Community Sessions, I have to read the NB Rules, Data Protection Notice and Waiver Policy (“Terms and Conditions”) below carefully and must agree to these Terms and Conditions to register. NB’s decisions are final and binding in all matters related to the NB Experience.

    NB EXPERIENCE RULES

    • NEW BALANCE MIDDLE EAST LLC is the organizer of the NBRC Community Runs, during which Participants will be allowed under supervision from New Balance and Aspire Park to physically participate in weekly running activities.

    • Only one digital entrance confirmation e-mail to enter the runs (“Entry”) per Participant for the community sessions is permitted. NB reserves the right to suspend, cancel or amend the Community Session(s) in its sole discretion and without notice to the Participant.

    • Participants in the NBRC Community Run(s) must be aged 18 and over. In the instance of the Participant being younger than 18 years of age, must be accompanied by an adult supervision (parent, relative and/or guardian) who will undertake responsibility for the said minor(s).

    • To the maximum extent permitted under applicable law, NB will not be liable to the Participant (and their guests, where relevant) for any loss, expense, damage, injury or disappointment suffered by any Participant resulting from entering or taking part in the Community Session(s).

    • Participant grants NEW BALANCE MIDDLE EAST LLC a perpetual license to use all comments, feedback and ideas that Participant shares with them, without notice, compensation/royalty or acknowledgement to Participant, for any purposes whatsoever, including, but not limited to, developing, manufacturing and marketing products and services and creating, modifying or improving products and services.

    • Participants who do not give correct details to receive an Entry, apply for an Entry on someone else’s behalf or apply for more than one Entry per person will be disqualified at NB’s discretion. Entries from agents, third parties, organized group entries, bulk entries or entries automatically generated by a computer will not be accepted. NB has sole discretion to determine whether an Entry is eligible. NB reserves the right to disqualify a Participant where it suspects there has been a breach of these Rules, where a Participant has gained unfair advantage or used fraudulent means or where a Participant might, in the reasonable opinion of NB, bring the NB brand into disrepute.

    • I agree that NB, its business partners, and/or any company which is, in relation to any such company (“NB business partners”) may photograph and/or film me during my attendance at and/or participation in the Community Session(s) and related activities (“Recording”) and may use my image, including for promotional, commercial and internal NB and NB business partners purposes. I grant NB and NB business partners the right to use for the maximum time allowed by applicable law, throughout the world and without any compensation or royalty, any Recording or photograph of me in any media, for the purpose of advertising, promotion, or any other commercial purpose in connection with the promotion of the Community Session(s) or future Community Session(s)s, in NB’s and NB business partners’ campaigns and/or for other NB and NB business partners’ promotional activities. I also grant NB and NB business partners permission to display my name, image, Community Session(s) standings and results during the Community Session(s) and for the same purposes as any Recording.

    • These Rules constitute the entire agreement between NB and the Participant and supersedes and extinguishes all previous drafts, agreements, arrangements, and understandings between them, whether written or oral, relating to its subject matter. These Rules cannot be altered or modified except by NB in accordance with the Rules. Participant agrees that it shall have no remedies in respect of any representation or warranty (whether made innocently or negligently) that is not set out in the Rules.

    • If any provision in these Rules is held, in whole or part, to be invalid or unenforceable for any reason, the validity of the remaining provisions of these Rules shall not be affected, and they shall continue to be valid and enforceable. The invalid or unenforceable provision shall be replaced with a valid provision which is as similar as possible in substance to the invalid or unenforceable provision.

    • This waiver shall be governed by and construed in accordance with the laws of the Emirate of Dubai, United Arab Emirates. Any disputes arising from or relating to this waiver shall be subject to the exclusive jurisdiction of the courts of Dubai.


    DATA PROTECTION NOTICE

    1. For the purposes of these Rules, the data controller is NB referenced above. In taking part in the Community Session(s), you will provide NB with certain personal data, such as contact details, personal details associated with the Community Session(s) and Recordings. You understand and acknowledge that by registering for the Community Session(s) and ticking the box to state that you agree with this Data Protection Notice, you give consent for NB to process your personal data. NB processes the personal data to administer and execute the Community Session(s), as well as to handle follow up matters after the Community Session(s). To the extent that you provide to NB any personal data of third parties, such as that of a guest, you acknowledge that you have collected the necessary consent of the third party for NB to process their data.

    2. You can withdraw your consent at any time by serving a notice in writing to newbalancepr@currentglobal.com. If you do this, NB will no longer be able to process your personal data and as a result you will no longer being able to take part in the Community Session(s). NB may share your personal data with third parties to process the data on NB’s behalf, solely for the purpose of administering and executing this Community Session(s).


    WAIVER POLICY

    1. I understand that I am solely responsible for any medical, health, or personal injury costs relating to my participation in the activities at the Community Session(s). I understand that I am strongly encouraged to have a medical physical exam and purchase health insurance prior to my participation for the activities at the Community Session(s).

    2. I confirm that I am physically fit and heathy to participate in the Activity and do not have any underlying heath conditions.

    3. I understand that participation in the Community Session(s) will entail an element of a risk of injury, illness, damage, loss and expenses associated with participation in the running activities mentioned in the Terms and Conditions above at the Community Session(s). By voluntarily choosing to participate in any of the activities at the Community Session(s), I hereby agree and undertake to indemnify and hold harmless NB, its principals, employees, representatives, and NB business partners against any liability which may arise in connection with the activities at the Community Session(s) or any violation or offense against any laws, regulations, cultural and moral customs of the the State of Qatar. I hereby expressly waive and release any claim that I may have against NB for any injury, illness, loss, damage and expense of any kind which arises as a result of my participation in the activities at the Community Session(s).
